Criminal Penalties

The crime of assisting information network criminal activities (“aiding crime”) was added as a new charge in the amended Criminal Law (Nine) that took effect in November 2015. It mainly refers to the behavior where a person knowingly provides internet access, server hosting, network storage, communication transmission, or other technical support for others to commit crimes using information networks, or provides advertising promotion, payment settlement, or other assistance, making them an important accomplice in telecommunications network crimes.

According to Article 287-2 of the Criminal Law, the statutory punishment for “aiding crime” is imprisonment for not more than three years or criminal detention, and a fine may also be imposed.

Occupation Ban and Prohibition Orders

According to the Supreme People’s Court and the Supreme People’s Procuratorate’s interpretation on handling criminal cases involving illegal use of information networks and assisting information network criminal activities, the judicial authorities may declare an occupation ban for those convicted of “aiding crime”; for those sentenced to control or probation, a prohibition order may be declared based on the crime circumstances.

Administrative Penalties

According to the Anti-Telecom Network Fraud Law of the People’s Republic of China that took effect on December 1, 2022, organizing, planning, implementing, or participating in telecommunications network fraud activities or providing assistance for such activities constitutes a crime, and criminal responsibility shall be pursued according to law. If the aforementioned behaviors do not constitute a crime, the public security organs may detain the person for not less than ten days but not more than fifteen days; confiscate illegal gains, and impose fines of one to ten times the illegal gains; if there are no illegal gains or the illegal gains are less than ten thousand yuan, a fine of less than one hundred thousand yuan may be imposed.

Disciplinary Measures

For bank cards, there will be measures such as credit penalties, business restrictions, and strict account management, which will affect the relevant persons’ loan and credit card applications for a certain period. For five years, related units and individuals will be suspended from non-counter banking services; for mobile cards, during the penalty period, the new network access services for the perpetrator will be stopped, and only one mobile number will be retained by the basic operators.
